Summary record of the STANDING COMMITTEE ON ZOOTECHNICS held in Brussels on 04 MARCH 2005
President: Alberto Laddomada, for points 7 and 8. The other points were co-presided by Alf-Eckbert Füssel and Kai-Uwe Sprenger.
All Member States were present except: Luxembourg, Malta, Italy and Slovenia. Luxembourg delegated its vote to Belgium.
On request from MS the Commission explained the system of entry in studbooks according to Decision 96/78/EEC in connection with Decision 92/353/EEC. It was stressed that an animal has a legal right to enter the main section of a studbook if its parents are entered in the main section of an approved studbook of the same breed. Further requirements for example performance/conformation may then merit the animal to be classified within the main section, if the main section is further divided into classes. It falls into the competence of the studbook of the origin of the breed to establish the principles to divide the main section into several classes. Furthermore the decision to establish a supplementary section falls also into the competence of the studbook of origin. A supplementary section cannot be maintained without providing for a rise of progeny into the main section.

Beim jüngsten Meeting der Shetland Pony Stud-Book Society (ISPC) im französischen Chantilly haben die anwesenden Mitgliedsländer (Österreich, Belgien, Dänemark, Finnland, Frankreich, Deutschland, Niederlande, Norwegen, Polen, Schweden, Schweiz und Großbritannien) der Shetland Ponys betreuenden Mitgliedsländer der EU und darüber hinaus folgenden Beschluss für Shetland Ponys mit weniger als drei registrierten Generationen im Pedigree verabschiedet und unterzeichnet: Ab 2006 müssen alle Ponys in jedem Zuchtbuch ein Minimum von drei vollständigen Generationen im Pedigree vorweisen, mit Ausnahme der Ponys, die vom Ursprungszuchtbuch (SPSBS) registriert wurden. Seit dem 3. April 2004 werden Ponys mit weniger als drei Generationen Pedigree für die Eintragung in anderen ISPC-Nationenen nicht mehr akzeptiert, außer sie wurden vom Ursprungszuchtbuch (SPSBS) registriert.

We have been contacted by some Swedish members who have expressed their astonishment to read on two Swedish websites reports of a speech given by Mr D. Dick at a dinner following stallion assessments in Holland in January 2008. In this report Mr Dick is described as being a representative of the Society It should be understood that Mr Dick attended this function purely in a private capacity and not as a representative of the Mother Stud-Book. He had and has no authority to speak on behalf of the Society.
As President of the Society I feel it is my duty to put the record straight on a few issues.
The current Dutch system of stallion inspection is totally illegal as it is contrary to EU legislation. Under Decision 96/78 EU it is illegal to prevent any pony whose sire and dam are already entered in the main section of a stud-book from being entered in the main section itself. As the Mother Stud-Book recognised by the EU it is up to the Society to enforce this.
Decision 96/78 EU was introduced some ten years ago and some may ask why the Society did not take steps to comply with the legislation then. Interestingly, for six of those years Mr Dick was in the position of Vice President, President and past President.
It was only due to concerns expressed by our Austrian daughter stud-book at one of the ISPC meetings that the legislation was finally debated and acted upon ten years later than it should have been. We the Mother-Stud-Book have had the clearest interpretation of this legislation from Brussels. This legislation is based on free trade and harmonisation of the stud books of all EU countries. The Shetland Pony Stud-Book Society, registered in Perth and the guardians of the Shetland pony breed for the last 117 years is the recognised Mother Stud-Book of Shetland ponies and as such has EU recognition. All Daughter Stud-Books within the EU countries are under an obligation to follow the rules set down by the Mother Stud-Book. We do not grade or select or section our stud-book. We believe that the stud-book layout in the same format as it has been from the very beginning is the best way to produce the best ponies and to protect the gene pool of the breed. We do not prevent ponies from breeding – that is against the law. This has nothing to do with trading, everything to do with preserving the breed and we consider we have the best Shetland ponies in the world.
Because Holland still continues a policy of inspection of ponies which denies some ponies their breeding rights and prevents free trade amongst EU member states, we have had no choice but to report this failure to comply with the law and this is now being handled by our respective Ministries. I am glad to report that the Swedish Ministry has now acted to implement the law and has stopped the discrimination caused by using different coloured passports.
The ISPC is very active and we the Mother Stud-Book take our responsibilities to our daughter stud-books extremely seriously. The International meeting in Perth in October was very well attended and visitors from our daughter stud-books expressed sincere gratitude for the help they had received in understanding the EU legislation and their own responsibilities to the Shetland Pony breed.
Mr Dick is also quoted as having misgivings about members recently being removed from the Society. Let me clarify this. Regretfully we have had the unpleasant task of removing four members from the Society, one due to unacceptable behaviour to our members of staff at Shetland House to whom we owe a duty of care and the other three after convictions of animal cruelty. It is abhorrent to me to suggest that anyone who has been convicted of animal cruelty resulting in the death of defenceless animals should continue as members of the Society. I trust no one thinks that this was unreasonable of Council to act in this way.
It should be noted that in recent months the English Irish Draught Society had its Daughter Stud-Book status removed for a period of six months, and last month the Fjord Horse Stud-Book Society incorporated under the Companies Acts and having its Registered Office at South Denhill, St Katherines, Inverurie, Scotland had its Daughter Stud-Book status (granted in 1999) removed due to non compliance of the EU legislation. If recognition of a Daughter Stud-Book is removed that Stud-Book may not trade any of its member animals within the EU. This has left their members in the unenviable position of having to acquire new passports for all their stock.
Members can rest assured that the Mother Stud-Book will continue to carry out her obligations as laid down by EU law and will ensure that all daughter stud-books comply with it.

The Shetland Pony Stud-Book Society who is the Stud-Book of origin of the breed of purebred Shetland Ponies (The Mother Stud-Book) were delighted to host a meeting for some of their Daughter Stud-Book Societies at the office in Perth on the 26th October 2007.
Representatives from Switzerland, Czechoslovakia, Hungary, Italy, France and France Shetland Passion were welcomed by the SPSBS International Committee and other Council members.
The President opened the meeting with a brief introduction of the history of the ponies in the Shetland Islands over 2000 years. The first Stud-Book was formed in 1890 with the registrations of 480 mares, 48 stallions (6 of these stallions were 42” and 2 were 34” and the mares average height was 39”) There were 111 members. A comparison was drawn between the entries in the first volume to those for the most recent Stud-Book year 2006 in which were registered 731 mares with 1st foals, 3156 foals, 278 stallions, 260 geldings. There are now 2268 members and 3863 transfers were recorded. 87 exports certificates were issued, 31 to Denmark, 20 to the Netherlands, 18 to France, 9 to Germany, 5 to Norway, 3 to Sweden and 1 to Belgium.
A talk was given explaining the EU legislation with details of the relevant Commission Decisions. The official approval as the Stud-Book of origin for the breed of pure bred Shetland ponies (Mother Stud-Book) was granted to the SPSBS on the 22nd April 1994.
A very useful discussion took place on all current applicable legislation and how it is applied to the Daughter Stud-Books. Legislation is based on complete free trade and harmonisation of all the Stud-Books. There must be no barriers to free trade between the EU countries and the reason the Mother Stud-Book sets the rules is to ensure co-ordination between organisations and associations which maintain or establish stud-books for registered equidae.
The EU rules are written for all equines and not just for Shetland ponies and an example was given of the success of the Thoroughbred society, Weatherbys, who is observed by all as an outstanding example of the harmonisation of stud-books between countries. We should not be afraid competition which is a good thing as it encourages better practises. Altogether it was a very friendly and productive meeting with a very good response from the Daughter Stud-Book representatives who expressed their gratitude for the help they had received with their many queries and for their better understanding of the legislation. Since the meeting there has been a great deal of feedback from the daughter stud-books present who are keen to comply with EU rules. The feeling was very positive that no one was being deliberately obstructive and all wished to further the good relationship that had been established between us all.

France Shetland Passion (FSP) said that in France the Ministry will not accept the EU Legislation regarding the existence of more than one recognised daughter studbook in any one Country.
The V. President said that it can be enforced .e.g. Austria have gone to the European Court of Justice and the ruling was that more than one daughter stud-book can be recognised in any one Country. For example in Germany there are 14 or more recognised daughter stud-books for Shetland ponies.
The V. President outlined the various different ways that the UK ensures that the correct standard of breeding is maintained such as the Voluntary veterinary examination and the many shows that encourage the best ponies are seen, rewarded and recognised and that we believe this is the way to maintain and improve the standard of breeding. She said the UK encouraged everyone in the EU to participate. The Mother Stud-Book had the clear right to set the policy for retaining the gene pool for the future of the breed. She said that we did not have any compulsive schemes but felt that competition and education was the best way to encourage breeders.
FSP: questioned a rule made in 2004 that it was a minimum requirement for all ponies to have three recorded generations of Shetlands ponies in their pedigree.
President: this was not the case but this had been a rule made for the German stud book which had always included spotted ponies and the UK had never allowed spotted ponies in the UK stud book.
Lorraine Manson: explained there was a doubt regarding the purity of the ponies in Germany due to their inclusion of spotted ponies.

President: gave explanation why the Stud Book was opened for inspected stock which was due to the shortage of registered ponies at that time. There was no inspected stock today.
FSP : there are many original ponies in their stud-book without papers. How can they get them back?
V. President: If you can prove DNA parentage we will accept them in the SPSBS. The point was that any stud-book should have only started with pure bred Shetland pony’s i.e. ponies who could trace their heritage directly back to the Shetland Isles.

Hungary: questioned ponies with three generations?
President: they must forget this rule which only related to Germany, but to register now they would have to prove parentage.
Hungary: Should they have to reject if ponies do not have three generations?
President: are the ponies in a recognised stud book?
Hungary: what is a recognised stud book?
President: any that is recognised as an official stud book. If parents are registered in a recognised stud book then their foals are acceptable. Explained that it was necessary for Hungary to become recognised as a daughter stud-book.

France: again raised query regarding rule for 3 generations?
President: they must ignore this
France: requested written conformation that this is correct
Vice President: gave explanation for the rights of entry to the SPSBS Mother Stud-Book. Explained the different sections for Stallions, Mares, Foals and Geldings.
FSP: stallions imported to France have a compulsory inspection.
Vice President: this is not legal.
FSP: points are allocated for different qualities of the pony. If it then passes it goes to the next level. Then he must be shown etc.
France: all stallions can produce, but inspection is voluntary. If they wish they can show and get extra points for example jumping etc.
Vice President: do they then discriminate against ponies not doing this?
France: Absolutely not, all stallions go into the same section in the main stud-book there is no sectioning of stallions and nothing is written on the registration or passport of a stallion which does not come forward for an evaluation and all progeny are treated the same regardless of whether the sire has been evaluated or not.
Czech: they can breed but the points are just a plus.
President: would like to clarify. Is any differentiation made in the French Stud-Book against these animals?
FSP: there is discrimination.
Vice President: which level do UK stallions go into?
FSP: level 3.
Vice President: EU legislation states no discrimination is allowed.
France: ISPC rules say this is okay.
Vice President: this is not the case.
Hungary: what if a stallion is no good?
President: every stallion has the right to breed. It is not always the best ponies that produce the best.
Vice President: the rules are based on purity
Hungary: can National rules be more restrictive than EU laws?
President: No
Norman Leask : the French are trying to change and so are some of the other countries. Our committee should look at their individual cases and try to help them comply with our own and the EU legislation.
President: Agreed. It is good that we are all trying to move forward. We have all started from different place and it takes time to change but the Mother stud-book rules must be followed.
France: no discrimination for stallions in their opinion.
FSP: they did not agree.
Norman Leask: we can sort it out.
President: can we receive copies of every countries’ Stud-Book to ensure that we all have the same rules.
France: Yes they will send copies of stud-book so the SPSBS can see there is no sectioning or levels of stallions in stud-book. The 2008 International Show will be held in Germany and it was regretted that Dr Miesner was not present.
President: were there any other questions?
France: queried the ISPC.
President: the ISPC is a committee of countries who are either already Daughter Stud-Books or would like to be, who meet with the Mother Stud-Book country in order to sort out problems. It is simply a forum for which the Mother Stud-Book has the responsibility.
France: Has the ISPC got its own rules?
Lorraine Manson: Any decisions made by the ISPC had to be discussed at the Mother Stud-Book council meeting and therefore in the past any decisions could take a long time. In the past Daughter Stud-Books and perspective daughter stud-books were invited. The ISPC had to have broader horizons and recognise that it was a forum for discussion only.
President: We have a duty to involve all Daughter Stud-Books.
France: requested the notes be sent to all countries not just those attending.
President: EU rules are binding. We have asked if there are any changes being planned to alter any of the current legislation and there are none. We are told that all countries involved are unanimous.
Vice President: the EU rules are written for all equines, not just for Shetlands.
Italy: they have tried to contact Brussels for help but have not succeeded.
Vice President: we will give them another contact to approach.
France: Why have some other ISPC members not attended, were there reasons?
President: No doubt there were but that was a question for them, they had all been invited.
Hungary: Can anyone become a member of the ISPC?
President: Yes. There is no joining, any recognised stud-book belongs automatically.
France: since 1991 meetings had been held in different countries.
President: from now on the meetings will be held in Perth.
Vice President: explained that it had been decided by the SPSBS Council that future meetings will be held in Perth. It was necessary to get away from the idea of the ISPC being a separate body. We need to realise that we all need to talk. For example Germany has 14 plus different stud-books altogether. We should not be afraid of healthy competition. If all stud-books are operating correctly there would be no need to worry about other ones starting. Stallions should not have any restrictions on them when imported. We would respect those stallions within our stud-book and request that all countries do the same.
Norman Leask: We do not insist on any specific stallions being used Individuals have the choice.
President: reminded meeting that the Irish Draught Horse Stud-Book had their status taken away due to the continuation of colt inspections. The Connemara Society also had to comply with the EU legislation. We must all get together as we have serious obligations.
The President thanked everyone for coming to Perth and closed the meeting.
